These terms apply to contracts between Hotel Fruerlund, proprietor Dimitrios Sotiriu, Glücksburger Str. 174, 24943 Flensburg, Germany, and its guests for rooms, apartments and agreed additional services. Individually agreed conditions and the terms stated for the selected booking rate take precedence.
1. Enquiries and contract formation
An enquiry alone does not reserve a room. An accommodation contract is concluded when the hotel confirms a binding booking or the guest accepts a time-limited offer within its stated period. Confirmation may be in text form, including email, or through the website or another digital booking channel. An automated acknowledgement is a booking confirmation only if expressly identified as such. Rooms not yet firmly booked may be released after an expressly agreed option period expires.
2. Services and prices
The services and prices stated in the booking confirmation apply. Breakfast, parking, pets and other extras are included only when expressly booked or confirmed. Room rates include statutory VAT. Flensburg's accommodation tax of 6.25% of the gross overnight room rate is charged in addition to the displayed room rate. It also applies to business stays. A particular room is guaranteed only if expressly agreed.
3. Arrival and departure
Rooms are available from 3 pm on arrival day until 10 am on departure day. Early arrival and late departure require agreement. Please notify the hotel in good time if you will arrive after 8 pm. Release of a room after 8 pm is possible only where an expressly agreed, unguaranteed reservation deadline has expired and no later arrival has been notified. Confirmed guaranteed bookings do not automatically lapse under this rule.
4. Late checkout
For an unagreed late checkout, the hotel may charge up to 50% of the agreed daily room rate until 1 pm and up to 100% after 3 pm for additional use. The period between 1 pm and 3 pm requires a separate agreement; otherwise only statutory claims remain. This does not create a right to extend the stay. Guests may prove that no loss or a substantially lower loss occurred. Reletting proceeds and saved expenses will be taken into account.
5. Payment and company invoices
Payment is due as stated in the booking confirmation and no later than departure. Any advance payment requires agreement. Mastercard, Visa and Girocard are accepted; cash payments must be in euros. Company billing must be agreed with the hotel. Where a company has confirmed responsibility for payment, the invoice must be paid within ten working days of receipt. Merely forwarding an invoice does not release a guest from their own payment obligation.
6. Cancellation, changes and no-shows
The cancellation conditions disclosed for the selected rate before booking take precedence. If no free cancellation right has been agreed, cancellation or a no-show may incur a flat compensation of 90% of the agreed price for accommodation without meals, or 80% for accommodation with breakfast. The same applies to changes amounting to cancellation and early departure for unused services. Reletting proceeds and saved expenses are deducted; unprovided extras are not automatically charged in full. Guests expressly retain the right to prove that no loss or a substantially lower loss occurred. Statutory cancellation and termination rights remain unaffected. Claims may be invoiced within three working days; charging a payment method requires valid authorisation.
7. No statutory withdrawal right for fixed dates
Accommodation contracts for non-residential purposes on a specific date or during a specified period generally carry no statutory withdrawal right under section 312g(2)(9) of the German Civil Code. Any contractually agreed cancellation rights remain available.
8. Group bookings
For bookings of five or more rooms, an electronic participant list must be supplied no later than two weeks before arrival. A separate deadline will be agreed for short-notice bookings. Please provide only information needed to organise the stay.
9. Smoking and damage
All rooms and apartments are non-smoking areas. Smoking is prohibited regardless of the product, expressly including e-cigarettes, shishas and cannabis. Tampering with, covering or disabling smoke detectors is prohibited. For a culpable breach, the hotel may charge EUR 300 per affected room for necessary special cleaning, including bedding, pillows, duvets, curtains and odour removal. Guests expressly retain the right to prove that no loss or a substantially lower loss occurred. Any proven greater loss, particularly damage to furnishings, necessary loss of rental income or a fire brigade response culpably triggered by the guest, may also be claimed. The flat fee is credited against this loss; the same costs will not be charged twice.
10. Pets
Animals are permitted only after prior notification and express hotel confirmation. Common household pets are permitted by prior arrangement with the hotel. The hotel charges EUR 15 per animal per stay. Without confirmation there is no entitlement to bring an animal. Statutory provisions for recognised assistance dogs remain unaffected.
11. Keys
Keys taken away accidentally must promptly be returned in person or by suitable insured post at the guest’s expense. Lost keys must be reported immediately. If the guest is responsible for the loss, necessary and actually incurred costs of a required lock replacement may be charged. A EUR 300 flat fee per key requires a corresponding typical loss and a genuinely necessary replacement. Guests expressly retain the right to prove that no loss or a substantially lower loss occurred.
12. Liability and defects
Statutory liability rules apply. In particular, liability for injury to life, body or health and for intentional or grossly negligent conduct is not excluded. Please report defects promptly so that the hotel can remedy them. Statutory rights regarding defects remain unaffected.
13. Applicable law and jurisdiction
German law applies, without affecting mandatory consumer protection or mandatory international jurisdiction rules. The place of performance for accommodation is Flensburg. Exclusive jurisdiction in Flensburg is agreed only where legally permitted, particularly in dealings with merchants, public-law legal entities and public-law special funds. Statutory jurisdiction rules apply to consumers.
